These Terms and Conditions (the “Terms”) govern your access to and use of the web-based Digital Content (the “Service”) provided by Oleksandr Shaulskyi (“Seller”, “We”), UID: CHE‐412.589.211, AHV‐No.: 756.9718.9008.40, address: Rietlistrasse 11, 8172 Niederglatt ZH, Switzerland, duly registered in Switzerland. By registering and using the Service, you agree to these Terms. Services and Digital Content are provided via elariaworld.com (the “Website”). Acceptance occurs by placing an Order and/or making payment.
1.1. The Buyer may choose not to place an Order if they disagree with these Terms. Placing an Order and paying constitutes full acceptance. 1.1.1. Only adults (18 years or older) may place an Order. Children may use the Service only under the supervision and responsibility of an adult, who confirms full legal responsibility for the child. 1.2. The right to use the Digital Content is granted after payment and activation. 1.3. We may update these Terms; changes take effect upon publication on the Website. Users will be notified of material changes.
“Website” — elariaworld.com. “Buyer” — the adult individual placing an Order. “Services / Digital Content” — online greetings, quests, videos, etc. “Order” — a purchase request placed on the Website.
3.1. The Buyer makes an Order by clicking “Create Adventure”, “Start your adventure”, or “Create Magical Adventure”. 3.2. Before submission, the Buyer can review and correct Order details. 3.3. The Service is delivered immediately upon successful payment. Buyers expressly agree that the Service is Digital Content and waive any statutory withdrawal rights.
4.1. All prices are available on the Website in euros (EUR) and include taxes and charges unless expressly stated otherwise. 4.2. Payment methods are those available on the Website. Services are provided only after full payment.
5.1. After payment, the Buyer receives access to the Digital Content (online greeting, quest, video, etc.). 5.2. Delivery of physical goods is not provided.
6.1. Refunds are available only before the service starts / before access is provided. 6.2. Once the Buyer has used the service (e.g., viewed the online greeting, completed the quest, or accessed the content), no refund is available, as the service has been fully rendered. 6.3. In case of a technical fault attributable to the Seller, replacement access or reasonable compensation may be provided.
7.1. We perform services in good faith and with due care. 7.2. The Service is provided “as is”. Liability is limited to direct damages; indirect, incidental, or consequential losses (including loss of profit) are excluded to the extent permitted by law. 7.3. The Buyer must notify the Seller of any defect immediately after discovery via the contact details on the Website.
All content (videos, designs, texts, characters, software) is protected. The Buyer is granted a limited, non-transferable license for personal use only, without redistribution or commercial use unless expressly permitted.
Personal data are processed under the Privacy Policy. Data are shared with third parties only where necessary to fulfil the Order (payment providers, hosting, etc.).
These Terms and Conditions are governed by Swiss law. For EU consumers, mandatory consumer law of their residence may apply. Disputes — courts of the Canton of Zürich, unless mandatory law requires otherwise.
